Opting In and Opting Out

We've gotten dozens of calls and emails from people all over the world about the 23andMe class action, and are grateful to everyone who has been in touch to share their stories.

Many people ask how they can join the lawsuit. At this stage of the litigation, the class is an alleged or putative class only. It doesn't become a full class until it is "certified" by the judge. That means you don't need to do anything to join the lawsuit; you're already a part of it, at least potentially.

By the same token, if you want to opt-out of the lawsuit for whatever reason, you don't need to do that yet. If and when the class is certified, you'll be given notice of the right to exclude yourself. Until then, you don't need to do anything in particular.

You always have the right to file your own individual lawsuit if you want. Under federal law, that's viewed as an implied opt-out.
